These Terms & Conditions (“Terms”) govern your use of www.onyxwindowfilms.com and your purchases from Onyx Distribution, the wholesale window film and paint protection film business of Onyx & Sons (“Onyx,” “we,” “us”). By using the site, placing an order online or by phone, or paying an invoice we send you, you agree to these Terms.
1. Who we sell to
Onyx Distribution sells to professional tint shops, detailers, installers and other businesses. Posted prices are wholesale prices. You must be at least 18 years old and authorized to make purchases on behalf of your business to place an order. We may decline or cancel any order, for example when stock is unavailable or a price was posted in error, and we will refund any amount already paid for a cancelled order.
2. Ordering and paying by invoice
No account is needed. When you place an order on the site or by phone, we create the order and email you an invoice from QuickBooks. You pay the invoice online by card or bank transfer (ACH) through QuickBooks Payments; we never collect card details on our pages or over the phone. An order is accepted and processed once its invoice is paid. Unpaid invoices do not reserve stock and may be cancelled after a reasonable time.
All prices are in U.S. dollars and may change without notice. The invoice is the final statement of what you owe: it shows the items, shipping and any applicable sales tax.
3. Sales tax
Sales tax is calculated on the invoice based on the shipping or pickup address, as required by law. If your business holds a valid resale certificate, tell us before you pay so we can apply it to your account; we may ask for a copy of the certificate.
4. Shipping and pickup
Orders ship by UPS from our warehouse in Lodi, California or Jarrell, Texas, whichever is closer and has the film in stock. Orders paid by 1:00 PM local warehouse time on a business day normally ship the same day. Shipping charges are shown on the invoice: Ground is free on three or more rolls (two rolls to CA, NV, AZ and OR); otherwise the live UPS rate applies. Faster UPS services are available on request at the live rate.
Pickup is available at 1351 E Pine St, Unit C, Lodi, CA 95240, Monday–Friday 9–4, once the invoice is paid. Risk of loss passes to you when the carrier accepts the shipment or when you collect a pickup order. Please inspect deliveries on arrival and report any damage or shortage promptly so we can make it right with the carrier.
5. Returns, exchanges and warranty
Film and PPF are sold by the roll and cut to order, so returns are handled case by case. If something is wrong with an order, call us within 30 days of delivery and we will work it out with you; unopened rolls in original packaging can usually be exchanged or refunded, and opened or cut rolls cannot be returned. If we shipped the wrong item, we cover the return shipping.
Onyx films carry a lifetime manufacturer warranty against bubbling, peeling, cracking, delaminating and color change; Forged PPF carries a 10-year warranty. Warranties cover the film, not labor, and are provided to the vehicle owner through the installing shop under the warranty documentation supplied with each product line. 6. Communications
By placing an order you agree that we may email, call or text you about that order (confirmation, invoice, shipping and pickup updates). Marketing emails or texts are sent only if you separately opt in; reply STOP to any text to opt out, or HELP for help. Message frequency varies and message and data rates may apply. Consent to marketing is never a condition of purchase.
7. Using the site
You agree not to misuse the site, interfere with its operation, scrape it, or use it for anything unlawful. The site, its text, images, videos and design belong to Onyx & Sons or its licensors and may not be copied or reused without permission.
8. Disclaimers and limitation of liability
The site and our products are provided “as is” except for the warranties stated above. To the fullest extent the law allows, Onyx is not liable for indirect, incidental or consequential damages, including lost profits or labor costs, arising from the site, an order or a product. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing here limits liability that cannot be limited by law.
9. Governing law
These Terms are governed by the laws of the State of California. Disputes will be resolved in the state or federal courts located in San Joaquin County, California.
10. Changes
We may update these Terms. The effective date above is the latest revision; continued use of the site or further orders after a change means you accept it.
